Solicitor petitions Family Court to prosecute alleged teen shooter as adult

BLUFFTON, SC – Solicitor Duffie Stone announced Tuesday he has petitioned Family Court to prosecute a 15 year old as adult following last week’s deadly shooting of another teenager on Hilton Head Island.

The defendant in this case is accused of shooting and killing 17-year-old Dominique Williams on July 19 near Coligny Beach.

The Family Court judge will decide the issue based on factors outlined by the U.S. Supreme Court. Those factors include:

  1. The seriousness of the alleged offense to the community and whether the protection of the community requires waiver.
  2. Whether the alleged offense was committed in an aggressive, violent, premeditated, or willful manner.
  3. Whether the alleged offense was against persons of against property, greater weight being given to offense against persons, especially if injury resulted.
  4. The merit of prosecuting the complaint, i.e., whether there is evidence upon which is grand jury may be expected to return an indictment.
  5. The child’s prior involvement with the juvenile justice system, if any.
  6. The prospects for adequate protection of the public and the likelihood of reasonable rehabilitation of the child by the use of procedures, services and facilities currently available to the Family Court.
  7. The sophistication and maturity of the child as determined by consideration of his home life, emotional attitude and living situation.

The Solicitor requested a pre-trial evaluation by the Department of Juvenile Justice to assist in the determination of the defendant’s sophistication and maturity.

At this time, the defendant has only been charged with a criminal offense and is presumed innocent.
